Terms of Use and Service
Please read these Terms of Use carefully because they govern your access and use of Traceback. If you do not agree with one or more provisions of this document, you should not use Traceback.
General
Welcome to the Traceback application ("the Application" / "the App"). The Application is operated by exempt dealer 211765300 ("the Operator"). This regulation governs the terms of use of the Application. Use of the Application constitutes full and unqualified agreement to all terms of this regulation. If you do not agree to these terms, please refrain from using the Application. The company reserves the right to change this regulation from time to time, and the changes will take effect immediately upon publication. Continued use of the Application after changes are made constitutes agreement to these changes. Use of the Application is permitted only for adults aged 18 and above.
About the Application and Services
The Application allows identification of callers from blocked or unknown numbers, and displays the details of the number owner (name or nickname) as they appear in the company's databases or those of third parties. The Application serves as an information platform only, based among other things on shared information (Crowdsourcing), and does not guarantee that the information is correct or up-to-date.
How the Service Works – Call Forwarding ("Follow Me")
Mechanism of Operation: To enable identification of the hidden number, use of the Application requires the user to set up "Call Forwarding" on their phone device in the "No Answer" or "Busy" state to a dedicated system number. When rejecting an incoming call, the call will be forwarded to the company's servers for identification purposes. Communication Costs: Please note that call forwarding may involve payment to your cellular operator (outgoing call minutes), according to your communication package. The company is not responsible for any financial charges that may be collected from you by the cellular operator due to the use of the call forwarding service. Cancellation of the Service Upon Deletion of the App: Uninstalling the Application from the device does not automatically cancel the call forwarding. It is the user's responsibility to actively cancel the call forwarding with the cellular operator and/or through settings before or immediately after removing the Application. The company will not be responsible for calls that continue to be forwarded if the user has not canceled the forwarding. The Application is available for download and service within the State of Israel. The Application is also active abroad under the following conditions: (a) Downloaded and installed in Israel (b) The app store (Google Play / App Store) is set to their location in Israel. (c) The Israeli number on which the Application was set is active abroad. It is clarified that if the user has changed the number on their cellular device – the Application will cease to operate, until the cellular number on which the Application was set is restored. Customers with a subscription who wish to change their cellular number can contact a contact person at the details listed below.
Contact Database and Information Sharing (Crowdsourcing)
For the purpose of providing the service and improving the identification database, the Application requests access to the contacts on your device. Upon granting access, the user authorizes the company to upload the contact details (names and phone numbers) to the company's servers and add them to the general information database. The user declares that they are authorized to provide this information and that they are aware that this information will be used by the company, among other things, for identifying these numbers for other users in the Application community ("Contact Sharing").
Responsibility and Limitation of Liability
The Application serves as an information platform only. The information (including names and nicknames of phone numbers) is collected from various sources, including from other users (User Generated Content). Accuracy of Information: The company does not guarantee that the information is correct, accurate, or up-to-date. There may be errors in identification or incorrect association of a name to a number. Offensive Content: Since the information is based in part on how contacts are saved by other users, nicknames that are not the official name may be displayed, and even nicknames that may be considered offensive, derogatory, or humorous. The company is not responsible, does not perform filtering, and does not attach labels to the content of the nicknames, their reliability, or any distress, defamation, or damage caused as a result of their display. The information is presented as is ("As Is"). The company will not be liable for any damage, loss, or expense caused to the user as a result of using the Application, relying on the information, or inability to locate a specific number.
Payments and Subscriptions
Downloading the Application is free. After registering for the Application and entering payment details, the user will be given the option to cancel the service at no cost, up to three days from the registration date. The company may offer advanced services or removal of advertisements, if they exist in the Application's model and software, in exchange for subscription fees ("Premium Services"). The terms of payment, cancellation, and renewal will be subject to the policies of the stores (Google Play / App Store) and the Consumer Protection Law 5741-1981, and all laws and regulations derived from it. Intellectual Property
All intellectual property rights in the Application (design, code, data) belong solely to the company. It is not permitted to copy or make commercial use of the data without written permission. Use of the Application is for personal viewing only.
Prohibited Behavior
It is not permitted to make illegal use of the Application, to harass, or to infringe on the privacy of others beyond the accepted identification purpose. It is not permitted to use the Application for "data mining" on other users. The company may block a user who violates these instructions.
Subjection to Law
The Application is subject to the laws of the State of Israel and operates in accordance with the law and the guidelines of the Ministry of Communications. If an administrative and/or commercial body, such as communication companies, blocks the service and/or the Application – the service will be canceled and future charges will be canceled, all subject to the cancellation and refund policies of the app stores.
